Terms and Conditions

Article 1 – Definitions

​

The terms used in these Terms and Conditions shall have the following meanings:

​

1. Company: SamishFit

2. User: A natural person who accesses SamishFit through Instagram, WhatsApp, the website, or the mobile application via the Internet and uses its services.

3. User Account: An account created by either the Company or the User for the purpose of accessing and using SamishFit services on the relevant platforms.

4. Purchase and Order Registration: Payment may be made through bank card transfers (using Iranian SHETAB network cards), online banking systems (including Stripe, credit or debit cards, or direct bank transfers, which are available only to users residing outside Iran), or any other payment methods approved by the Company in accordance with these Terms and Conditions.

5. Initial Personal Information Form: The electronic form completed by the User containing identification details, physical condition, body status, and any other information required by the coach to prepare personalized training and/or nutrition plans.

6. Program Period: The period during which a workout Plan, Diet plan, or both are provided to the User.

Article 2 – User Account

1. Users agree not to share their account or their fitness and nutrition programs with any other person. If account sharing is detected, the Company reserves the right to terminate services and deactivate the relevant account(s).

2. By registering with SamishFit and each time the User accesses its services, the User confirms that they have carefully read, understood, and accepted these Terms and Conditions. The Company reserves the right to amend these Terms at any time. Continued use of the services constitutes acceptance of any such changes.

3. Users are responsible for providing complete, accurate, and up-to-date information in the Initial Personal Information Form. The Company shall not be liable for any consequences resulting from inaccurate or incomplete information.

4. Users must register using a mobile phone number that belongs to them. Otherwise, the User shall bear full legal responsibility toward the rightful owner of the number, and the Company may terminate the User's account upon becoming aware of such misuse.

5. The User is solely responsible for all activities conducted through their account on the application, website, or any other SamishFit platform. Use of a User's account by any third party is prohibited and may result in immediate suspension or termination of the account.

6. The Company may require identity verification in certain circumstances. Failure to provide sufficient verification information may result in suspension of the User's account and refusal of services.

7. Users must disclose any medical conditions, physical limitations, allergies, or sensitivities in the Initial Personal Information Form. Failure to do so shall make the User solely responsible for any resulting consequences, and no refund will be issued after acceptance of the request.

8. If the User selects a gym as their training location, individual equipment cannot be specified. Workout programs will be designed based on the assumption that standard gym equipment is available.

9. Nutrition plans are prepared according to the information provided by the User and their stated goals. While the Company will make reasonable efforts to consider User preferences, professional standards and coaching judgment shall take precedence. The Company is not obligated to accommodate every request listed in the User's form.

10. The Company does not provide services to pregnant women, breastfeeding mothers, or individuals who, in the Company's professional opinion, should be under the supervision of a qualified physician.

11. The Company does not provide services to individuals under the age of sixteen (16).

12. The User agrees that SamishFit may communicate through SMS, email, WhatsApp, or other messaging platforms. Users may request to stop receiving such communications; however, they acknowledge that doing so may affect their ability to receive important service-related information.

13. The Company may provide promotional or discount codes that reduce the price of a program or return a portion of the fee after payment. The issuance, validity period, and conditions of these codes are solely determined by the Company, and Users shall have no claim if such codes are unavailable.

14. Users may not transfer, sell, or publicly distribute promotional codes unless expressly authorized by the Company.

15. Promotional or discount codes may expire. Since these codes are provided free of charge, the Company reserves the right to modify their value, percentage, or cancel them at any time.

16. If the Company determines that a promotional code has been used due to a technical error, fraud, misuse, or any unlawful activity, it may invalidate the code and revoke any related credits or discounts.

17. Users agree not to purchase or request programs for any other individual using their own account. If such activity is discovered after acceptance of the request, the Company reserves the right to cancel the order.

Article 3 – Payments

1. Users acknowledge that program fees are determined solely by the Company and may not be disputed after purchase.

2. Once the Company has delivered the User's program, cancellation is not permitted, and all payments are non-refundable.

3. Users must carefully review the delivered program. If any errors or inconsistencies exist, they must notify the support team within seventy-two (72) hours. The support team will review the request and provide a response as soon as possible.

4. If the Company approves a revision request, a maximum of five (5) revisions will be provided.

5. Payments must be made only through the payment methods approved by SamishFit, as described in Article 1, Clause 4.

6. Program fees may change as new features or services are added. Users waive any right to object to revised pricing.

7. If payment cannot be completed due to internet outages, telecommunications issues, or similar technical problems, the User remains responsible for payment. Alternative payment arrangements may be coordinated through SamishFit support. Failure to complete payment may result in suspension of the User's account and restriction of services.

8. After payment has been made, Users must complete and submit the Initial Personal Information Form within one (1) week. Failure to do so will result in forfeiture of the payment, which shall not be refunded under any circumstances, and the User shall bear full responsibility.

Article 4 – Responsibilities of SamishFit

1. The Company continually strives to improve its services by monitoring performance and collecting User feedback at the end of each program.

2. The Company will make reasonable efforts to ensure access to its software services but does not guarantee compatibility with every device, operating system, internet connection, or mobile network.

3. All User information shall be treated as confidential and protected by the Company. Such information will not be disclosed to third parties except where disclosure is required by a competent judicial or governmental authority.

4. Users who experience issues while using the services may submit complaints through the Company's support channels. The Company will make reasonable efforts to investigate and respond.

Article 5 – Force Majeure

1. The Company shall not be liable for delays or failure to provide services resulting from events beyond its reasonable control, including but not limited to internet outages or telecommunications disruptions.

2. Once such circumstances have been resolved, the Company may extend the duration of services or take other reasonable measures to compensate for the interruption.

Article 6 – Suspension or Termination of Services

If the Company determines, at its sole discretion, that a User's conduct poses a risk to the Company, its staff, or other Users, or is otherwise inappropriate, it may suspend or permanently terminate the User's access to its services without liability. The User shall have no right to compensation or objection.

Article 7 – General Provisions

​

1. Users are solely responsible for maintaining the confidentiality and security of their accounts. Any messages or communications sent through the registered account or associated messaging platforms shall be deemed to have been sent by the User. Any claim denying authorship or alleging forgery shall not be accepted.

2. The User agrees that any communication issued electronically—including text messages, voice messages, photographs, confirmations, acknowledgments, or other electronic communications—shall constitute a valid electronic signature and legally binding acceptance. Any challenge to such electronic confirmation shall not be admissible.​
